TERMS & CONDITIONS
Please read these booking conditions carefully; they are an important part of your contract for your holiday. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these terms and conditions, and agree to them.

1. DISCLAIMER
While every effort is made to offer the courses set out on this website, Fiona Fouhy reserves the right to withdraw particular courses and to change both the content and the pricing of a course when need arises, without prior warning. Participants who have already paid in full for a course will not be subject to any such price increase. Minor changes of course content will not be considered to affect our cancellation policy, as set out in Fiona’s Refund & Transfer Policy (no.4).

2. COMMUNICATION
We communicate with you by email. If you do not receive a confirmation from us about booking of a course, call us on 07747807993.
YOUR COURSE IS ONLY BOOKED IF YOU HAVE HAD CONFIRMATION FROM US.

3. COVID 19

The government has removed remaining domestic restrictions in England. There are still steps you can take to reduce the risk of catching and spreading the virus, including letting fresh air in and wearing a face covering or face mask in certain situations. We will be outdoors a majority of the weekend but will keep windows open when indoors.

It is also important to consider that others may wish to take a more cautious approach. We should all be considerate of this, and provide the opportunity and space for others to reduce close contacts if they wish. 

Please see section 5.c) for guidance on cancellations due to illness.


4. GENERAL INFORMATION

a) Your participation on the course.
Participation on our walks and activities requires an appropriate level of fitness. We reserve the right not to accept participants on our walks and activities if, in the reasonable opinion of the leader, this would compromise the safety or enjoyment of an individual or the group as a whole.

We reserve the unconditional right to refuse a booking or to debar a person from a course in the event of conduct which in our reasonable opinion is likely to cause distress, damage or annoyance to guests, employees, property or to any third party.

If you or any of your party do not take up your accommodation within 24 hours of the date of arrival shown on your confirmation, it will be offered for re-letting.

Bookings are for those of 18 years and above.

No pets or children allowed.

b) Complaints & Giving Feedback
We want to know about your experience on Fiona’s workshop. This will help us to continue improving. Get in touch by emailing us at fifouhy@hotmail.com.
Complaints
If you have a complaint during your course you must notify the course leader immediately and they will do their best to resolve the problem. Should it not be possible to resolve your complaint there and then, you should write to our office within 28 days. All complaints that are received are thoroughly investigated and participants are kept informed. Sometimes investigations can take time, especially when awaiting a response from suppliers. We aim to settle all complaints amicably.

5. REFUND & TRANSFER POLICY

a) PAYMENT
A 25% deposit is required to secure a booking. The rest of the payment is then due 6 weeks prior to the workshop. Payment is made by BACS and banking information will be sent to you by email. You will receive a confirmation email when the transfer is complete.

b) CANCELLATIONS BY US
If a course is cancelled by Fiona Fouhy, participants will be notified and given the opportunity to transfer to another course. Otherwise the full cost of fees will be refunded within three weeks, under normal conditions. We shall not be liable for any other consequential loss.

If we cancel your course
We make every endeavour to operate our courses. If we have to cancel your course, you will have the choice of taking an alternative course (and where this is of a lower price we will refund the difference) or withdrawing from the contract and accepting a full refund of all monies paid. We shall not cancel a course after the date when the payment of the balance becomes due, unless this is as a result of force majeure.

Force Majeure
We will not pay you compensation if we have to cancel or amend your course as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid. Examples include war or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, level of water in rivers or other similar events beyond our control.

c) CANCELLATIONS BY YOU
Cancellations on the part of the participant made less than 30 days before the start of the course are non-refundable. For cancellations made before that time, the participant will be refunded the full amount minus the deposit of 25%.

If you wish to transfer your confirmed booking to another person, you can do so, provided that this is not later than the day on which the balance of your holiday is due. You, as transferor of the course, and the transferee shall be jointly and severally liable to us for the payment of the balance due.

If you return home early from your course (or are unable to take part in the activity), we cannot refund the cost of any services you have not used. Depending on the circumstances you may be able to claim on your travel insurance.

NON-ATTENDANCE
Non-attendance of a workshop due to illness, or for personal or professional reasons does not provide the right to refunds, extra tuition or transferral to another class. However, in such an event we shall consider all the circumstances and take such action that we consider fair and reasonable, subject to availability.

6. DATA PROTECTION
Personal Data
By purchasing a workshop place you give the Fiona Fouhy permission to process your personal data (as defined in the Data Protection Act 2018 and General Data Protection Regulation 2018) for the purposes of administration of Fiona Fouhy’s courses. Data will be stored securely, treated confidentially and will not be disclosed to external organisations. The data will be used, unless you tell us otherwise, for statistical and course quality monitoring processes and will be retained by Fiona Fouhy for a period of 42 months, unless you have opted to receive business and marketing information from Fiona Fouhy.


7. LIABILITY
Our responsibility
(i) Where you do not suffer death or personal injury, we accept liability should any part of your course arrangements booked with us not be as described on the website and not be of a reasonable standard, and, subject to (iii), (iv) and (v) below, will pay you compensation of an amount which could be reasonably and properly expected, taking into account all the relevant circumstances.
(ii) Where you suffer death or personal injury as a result of an activity forming part of your course arrangements booked with us before departure, we accept responsibility subject to (iii), (iv) and (v) below.

(iii) We accept liability in accordance with (i) and (ii) above and subject to (iv) and (v) below except where the cause of the failure in your course arrangements or any death or personal injury you may suffer is not due to any fault on our part or that of our servants, agents or suppliers, and is your own fault, or arises from the actions of someone unconnected with your course arrangements or due to unusual or unforeseeable circumstances or events which neither we, nor our servants, agents or suppliers could have anticipated or avoided even with the exercise of all due care.

(iv) Where a claim (whether for personal injury or non personal injury) arises out of loss or damage suffered during the course of rail travel, sea travel or road travel the amount of compensation you will receive will be limited in accordance with the provisions of any relevant International Conventions, namely the Warsaw Convention 1929 (including as amended by the Hague Protocol 1955), the Berne Convention 1961, the Athens Convention 1974, the Geneva Convention 1973 and the Paris Convention 1962.

(v) It should be noted that our acceptance of liability in (i), (ii), (iii) and (iv) above is conditional upon you assigning any rights to us that you may have against any of our servants, agents or suppliers which is in any way responsible for the failure of your course arrangements or any death or personal injury you may suffer. Finally, it is a condition precedent of such acceptance of liability that you follow the procedures for the notification of complaints set out below.

(vi) Other than as set out above, and as is detailed elsewhere in these conditions of booking, we shall have no legal liability whatsoever to you for any loss, damage, personal injury or death which you suffer arising directly or indirectly from any aspect of any course arrangements booked with us.

8. WEBSITE ACCURACY
The information and prices on our website have been carefully checked and we believe they are correct at the time of publication. Occasionally changes and errors can occur and we reserve the right to make changes; if this occurs we will advise you before your booking is confirmed. We feel it is right to point out that advertised facilities may be subject to change by the various suppliers concerned. There may be occasions when an advertised facility or activity is not available during your course. This may be due to weather, operational or maintenance reasons. Walks and activities may be subject to variation or cancellation due to weather, or operational considerations and we cannot guarantee that a particular walk will operate during a course.
